These Terms of Service ("Terms") govern your use of ivacrowd.com and the IVA CROWD platform. By creating an account, publishing a campaign, or contributing to one, you agree to these Terms. If you do not agree, do not use the service.
1. What IVA CROWD is
IVA CROWD is a technology platform that allows organisers to publish fundraising campaigns and allows backers to contribute to them. We are not a party to the relationship between an organiser and a backer. We do not create campaigns, we do not guarantee that a project will be completed, and we do not endorse any campaign. We provide the tools, review campaigns against our policies, and process payments through third-party providers.
2. Eligibility and your account
- You must be at least 18 and legally able to enter into a contract.
- You must provide accurate information and keep it current.
- You are responsible for your account credentials and for all activity under your account.
- One person or organisation may not maintain multiple accounts to evade limits, fees or enforcement.
- You must complete identity verification before withdrawing funds.
We may refuse, suspend or close an account where we reasonably believe these Terms have been breached, where verification cannot be completed, or where we are required to do so by law or by a payment provider.
3. Organiser obligations
If you publish a campaign, you agree that:
- Your campaign description is accurate and not misleading, and you will correct it promptly if circumstances change.
- You will use funds raised only for the purpose stated on your campaign page.
- You will deliver any rewards, perks or commitments you have promised, or refund backers where you cannot.
- You will keep backers informed with campaign updates, particularly where there are delays or material changes.
- You have the right to use all content you upload, and you have obtained any consents needed for photographs of identifiable people.
- You will comply with all laws applicable to your fundraising, including charity registration, consumer protection, tax and licensing requirements.
- You will not use contributor information for any purpose other than the campaign.
Failure to use funds for the stated purpose is a material breach and may result in suspension of payouts, removal of the campaign, refunds to backers, and referral to the relevant authorities.
4. Backer terms
- Contributions are made to the organiser, not to IVA CROWD, and are generally non-refundable.
- Contributions are donations. They are not investments, loans or purchases, and they carry no financial return, ownership interest or repayment right.
- Whether a contribution is tax-deductible depends on the organiser's status and your jurisdiction. We do not provide tax advice.
- You are responsible for evaluating a campaign before contributing. We review campaigns against our policies but cannot guarantee any outcome.
- Refunds may be available in the limited circumstances described in our Trust & Safety policy.
5. Prohibited campaigns and conduct
You may not use the service to raise funds for, or engage in: unlawful activity; fraud or misrepresentation; weapons, ammunition or controlled substances; investments, securities, loans or any promise of financial return; gambling, lotteries or raffles where not permitted by law; hate speech, harassment or incitement to violence; unproven or dangerous medical treatments; adult content; impersonation of a person or organisation; or the evasion of sanctions or export controls.
You also may not scrape the platform, attempt to gain unauthorised access, interfere with its operation, or use it to distribute malware or spam. The full policy list is set out in Trust & Safety and forms part of these Terms.
6. Fees
Our fees are set out on the Pricing & Fees page and are incorporated into these Terms. Fees are deducted from contributions before payout. Payment processing fees are charged by our payment providers. We may change our fees on 30 days' notice to account holders; changes do not apply retroactively to contributions already received.
7. Payouts
- Payouts are made only to a verified account in the name of the organiser or their organisation.
- Payout requests are reviewed before release, normally within one business day.
- We may delay, hold or reverse a payout where a campaign is under review, where a dispute or chargeback is pending, where verification is incomplete, or where we are required to do so by law or by a payment provider.
- Where funds cannot be paid out and cannot be returned to backers, they will be handled in accordance with applicable unclaimed-property law.
8. Content and licence
You keep ownership of the content you publish. By publishing it you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for formatting purposes, and display that content in order to operate and promote the service. This licence ends when you remove the content, except for copies retained in backups or required for legal records, and except for material already used in published promotional contexts.
The IVA CROWD name, logo, software and site design remain our property. Nothing in these Terms transfers any right to them.
9. Removal and suspension
We may remove content, suspend a campaign, withhold payouts or terminate an account where we reasonably believe these Terms or our policies have been breached, where required by law, or where necessary to protect users. Except where prohibited or where prior notice would compromise an investigation, we will tell you the reason and give you an opportunity to appeal to a reviewer not involved in the original decision.
10. Disclaimers
The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, and we make no warranty regarding any campaign, organiser or project.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the service is limited to the greater of the fees we received from you in the 12 months before the claim, or 100 in your account currency. Nothing in these Terms limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.
12. Indemnity
You agree to indemnify and hold harmless IVA CROWD, its affiliates and its staff against claims, losses and reasonable legal costs arising from your campaign, your content, your use of the service, or your breach of these Terms or of any law.
13. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which IVA CROWD is established, and the courts of that jurisdiction have exclusive jurisdiction, except where mandatory consumer protection law in your country of residence gives you the right to bring proceedings locally. Before starting formal proceedings, both parties agree to attempt in good faith to resolve the dispute by contacting the other.
14. Changes to these Terms
We may update these Terms. Material changes will be notified to account holders by email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance. If you do not accept the change, you may close your account.
15. General
If any provision is found unenforceable, the remainder stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of assets. These Terms, together with the Privacy Policy, Trust & Safety policy and Pricing & Fees page, are the entire agreement between us.
